In Germany, organ donation is regulated by the Transplantationsgesetz (TPG). The specifications are under “Richtlinien für die Wartelistenführung und die Organvermittlung” and from Bundesärztekammer (BäK) defined. When approving the removal of the donor organs, Germany has regulated what is known as the decision-making system.
This set of rules, also known as “OPT-IN”, has developed to the detriment of patients in Germany in a European comparison, since many European countries have prescribed the “OPT-OUT, objection rule” in their transplantation law and thus no such unbearably long waiting times as here have in Germany.
